In the event the Publishing Fund is not used in full in any calendar year of the Term, the unused part of the Publishing Fund for that calendar year will lapse and will not be rolled over into any subsequent calendar year. Further, except as set forth in Clause 2.5, the Publisher shall have no liability or other obligations to the Licensee in relation to the unused Publishing und, including but not limited to making a refund equivalent to any unused APCs or increased Publishing Fund amount in subsequent Term years as set out in Schedule 4. |
