FINANCIAL SHIFT
Transformative agreements vary by their transformative mechanisms, meaning the way in which financing is shifted from the subscription side to open access publishing. What are the characteristics of this agreement to this regard? |
Subscriptions partly converted to OA publishing fees |
RISK SHARING
How do entitlements for open access publishing correlate to the anticipated article output? Which mechanisms for risk sharing have been agreed in cases of exceeding or not reaching the number of OA publishing entitlements? |
Overpublishing: Consortium Member Institutions may publish additional Eligible Articles at no extra cost up to the top of the corridor. For each article published above the Article Max, the provisions of clause 3.1.5 of the Product Terms will apply. In such case, the APC will be based on standard list price APC for the respective journal and the additional APCs will then be invoiced to the corresponding Consortium Member Institution or the Eligible Author separately, as set forth in clause 3.1.5 of the Product Terms.Underpublishing: If Consortium Member Institutions publish less than the Article Min. threshold, Supplier will, within the first quarter of the following year of the Term, refund Subscriber an amount corresponding to the difference between the Article Min. threshold and the number of articles actually published, multiplied by the Agreed APC Rates. In the event of the foregoing, Licensor will correct the corresponding invoice to reflect the refund. For the avoidance of doubt, this refund is Subscriber’s sole remedy in case of underpublishing and the parties agree that the APC Fund shall otherwise expire at the end of each calendar year. For clarity: If the number of published articles is below the Article Base, but is not less than the Article Min, the APC Fund shall expire at the end of each calendar year. However, if the Subscriber has a right to receive a refund, it will not expire at the end of the Term. |
